Home Office written question – answered on 5th January 2022.
To ask the Secretary of State for the Home Department, what assessment she has made of the implications for her policies of the Independent Monitoring Authority's recent decision on the legality of the Government's policy with respect to the Withdrawal Agreement and the rights of EU citizens in the UK.
The Government does not agree with the Independent Monitoring Authority's analysis of the Withdrawal Agreement. It has been the UK’s long-standing position people granted pre-settled status under the EU Settlement Scheme will have to apply for settled status before their pre-settled status expires.
We have implemented the arrangements we agreed under the Withdrawal Agreement in good faith.
