To ask the Secretary of State for Environment, Food and Rural Affairs, if he will make it his policy to make failure to abide by the Code of Practice for the Welfare of Horses, Ponies, Donkeys and their hybrids a criminal offence.

A breach of the statutory Code of Practice for the Welfare of Horses, Ponies, Donkeys and their Hybrids is not an offence itself but if proceedings are brought against a person for an offence under the Animal Welfare Act 2006, the Court will look at whether or not the person complied with the code in deciding whether they have committed an offence.
