To ask Her Majesty’s Government whether the Department for Business, Innovation and Skills has set out any guidance to the Competition Commission relating to the assessment of cultural value in its judgments; and, if no such criteria exist, whether they have any plans to introduce any.

The Department has not issued any such guidance and does not plan to do so.

The Competition Commission (CC) is an expert, independent organisation whose powers are set out in the Competition Act 1998 and the Enterprise Act 2002. The range of powers includes the power under Part 3 of the Enterprise Act 2002 to decide whether a merger gives rise to a substantial lessening of competition within any market or markets in the UK.
