To ask the Secretary of State for Work and Pensions what guidance is given to Jobcentre Plus staff on the application of sanctions; and whether that guidance is publicly available.
There is a wealth of guidance available to Jobcentre Plus staff on the application of sanctions. The primary guidance products are the Labour Market Conditions Guide and the Decision Makers Guide.
The Labour Market Conditions Guide details the conditions attached to the receipt of jobseeker's allowance, and the actions for advisers to take where they have doubts about a claimant meeting any of those conditions. This guidance is not published. The Decision Makers Guide details the considerations decision makers must make when determining whether or not a sanction should be applied, and includes details of the appropriate social security legislation and case law.
