To ask the Secretary of State for Health what assessment has been made of the ability of service users with learning difficulties to manage their direct payments for social care.
The Department has not made an assessment of the ability of people with learning disabilities to manage their direct payment. Direct payments offer people choice and control over how their care and support is provided. It is mandatory for local authorities to offer direct payments to people eligible for social care services who consent to, and are able to, manage payments.
Local authorities are responsible for determining whether a person is capable of managing a direct payment. People can receive assistance in managing their payment and the Community Care, Services for Carers and Children's Services (Direct Payments) (England) Regulations 2009 allow direct payments to be made to a suitable person who receives and manages the payments on behalf of a person who lacks capacity.
