To ask the Secretary of State for Culture, Olympics, Media and Sport what plans he has to implement sections nine to 17 of the Digital Economy Act 2010.
The Secretary of State for Culture, Olympics, Media and Sport, my right hon. Friend Mr Hunt, has no plans to impose technical obligations on internet service providers under section 10 of the Digital Economy Act at this time. The Secretary of State is currently working towards commencement of the initial obligations set out in sections 3 and 4 of the Digital Economy Act. The power to impose technical obligations to take technical measures against subscribers set out in section 10 is a reserve power that cannot be exercised until such time as the Initial Obligations Code has been in force for 12 months, and evidence of its effect has been reviewed. Furthermore, before considering whether to impose technical obligations, the Secretary of State will seek an assessment from Ofcom of the likely efficacy of technical measures.
As announced in August 2011, site blocking regulations under sections 17 and 18 will not be brought forward at this time. This decision was reached following advice from Ofcom, also published in August 2011.
