To ask the Secretary of State for Business, Innovation and Skills what assessment he has made of the effects on (a) the viability of businesses and (b) levels of employment of requiring suppliers to continue to supply companies in administration.
The Government are currently considering the case for updating Section 233 of the Insolvency Act 1986 and the wider issue of termination clauses. My officials at The Insolvency Service are meeting with stakeholders to hear their views and to gauge an initial view of the merits of such a change, including an initial assessment of the costs and benefits. Further detailed quantifiable evidence will be required if this issue is taken forward.
