To ask the Secretary of State for the Home Department what her response is to the judgment of the European Court of Human Rights in the case of Sufi and Elmi vs the United Kingdom; and whether she plans to appeal.

The European Court of Human rights handed down judgment on 28 June 2011 in the case of Sufi and Elmi v. The United Kingdom (Applications nos. 8319/07 and 11449/07) which concerned safety of returning failed asylum seekers to Somalia.

We are disappointed with the European Court's decision and are considering our legal position.

This judgment does not mean that all Somalis are in need of international protection. We will continue to pursue the removal of those with no right to be in the UK, including the removal of Somali criminals who have committed a serious crime.
