To ask Her Majesty's Government whether those responsible for managing and operating privatised services at HM Prison Birmingham will be treated as public authorities for the purposes of the Human Rights Act 1998.

When HMP Birmingham is run privately, it will perform functions of a public nature within the meaning of Section 6 of the Human Rights Act 1998. In the YL case, the House of Lords confirmed that privately run prisons perform functions that fall within that provision.
