To ask the Secretary of State for Justice pursuant to the answer of 10 March 2011, Official Report, column 1284W, on sentencing: appeals, what power a Crown court appeal tribunal has to send a case to the Crown court for sentence where it believes that the magistrates court's powers are insufficient in all circumstances.
When the Crown court determines an appeal against conviction or sentence in a magistrates court, its sentencing powers are limited to those that were available to the magistrates court.
