To ask Her Majesty's Government further to the Written Answer by Lord Adonis on 13 January (WA 166), and following the judgment of the Competition Appeal Tribunal of 21 December 2009 in BAA Limited v Competition Commission (CAT 35), whether it was appropriate for Strategic Transport Solutions to participate in the review commissioned on behalf of the General Lighthouse Authorities on the impact of light due increases, when one of its partners was also a board member of the Commissioners of Irish Lights.

Further to my Written Answer on 13 January, I do not consider the judgment referred to by the noble Lord to be relevant. While it is correct that a partner in Strategic Transport Solutions is a board member of the Commissioners of Irish Lights, the possibility of an apparent conflict between those positions was considered at the time and appropriate steps were taken to ensure that person took no part in the review of the impact of light dues increases.
