The sale of any food that is unsafe is already prohibited by Regulation (EC) 178/2002. Food is considered to be unsafe if it is either injurious to health or unfit for human consumption. The General Food Regulations 2004 and the General Food Regulations (Northern Ireland) 2004 create offences of contravening or failing to comply with the food safety requirements of Regulation (EC) 178/2002.
