Consent is a vital element of the Data Protection Act and any organisation that offers a service which involves the use of personal information has to be clear on how consent should be obtained. Any judgement about the adequacy of such arrangements is a matter for the Office of the Information Commissioner as the enforcement body for data protection legislation in the UK.
