Justice written question – answered on 16th July 2008.
To ask the Secretary of State for Justice if he will make it his policy to bring forward proposals to remove the current provisions in common law which prevent a person with mental illness from standing or remaining as an hon. Member; and if he will make a statement.
Under the Electoral Administration Act 2006 we have already abolished the common law provisions which related to mental state for voters.
We will consider with our stakeholders whether a similar change should be made to remove the current provisions in common law which may be used to prevent a person who has experienced mental health problems from standing or remaining as an hon. Member.
