Treasury written question – answered at on 7 February 2005.
To ask the Chancellor of the Exchequer what estimate he has made of the likely reimbursement of tax revenues necessary if actions of a similar class to the Marks and Spencer case against the Inland Revenue at the European Court of Justice are successful.
It is impossible to assess how many other potential litigants are in the same circumstances as Marks and Spencer. Consequently, it is not possible to quantify the amount of tax potentially reimbursable.
