The area defined as Scottish territorial waters extends out to 12 nautical miles from the coastal baseline. In addition, Scottish Ministers have the function of granting consents under section 36 of the Electricity Act 1989 for offshore wind farms both in the territorial sea adjacent to Scotland and in the sea area identified in the Schedule to the Renewable Energy Zone (Designation of Area) (Scottish Ministers) Order 2005 (S.I. 2005/3153).
