To ask the Scottish Executive whether procurators fiscal have increased the proportion of applications for special bail conditions since January 2009.

Frank Mulholland QC:

Case records in the Crown Office and Procurator Fiscal Service’s case management database do not contain any electronically searchable information about applications for special conditions of bail. It is not possible to extract information of the type requested.

Guidance to procurators fiscal makes it clear that additional or special conditions of bail should be sought in appropriate cases where they provide an acceptable alternative to remand in custody.
