To ask the Scottish Executive what action the Crown Office and Procurator Fiscal Service is taking to address homophobic hate crimes in light of the recent announcement by the Crown Prosecution Service about action it is taking to tackle this issue in England and Wales.

Mrs Elish Angiolini:

Homophobic hate crimes are taken seriously and prosecuted vigorously by procurators fiscal. There is currently no systematic collection of data in relation to the occurrence of such crimes. The Crown Office and Procurator Fiscal Service is committed to examining, with our criminal justice partners, how best to allow such collection, both in relation to information contained in police reports to procurators fiscal and in information held about cases prosecuted in the courts.

In addition, we are working as part of our diversity strategy to strengthen our contacts within the gay, lesbian, bisexual and transgender communities so as to obtain a better understanding of their concerns.
