The hon. Gentleman is very good at such questions. Unfortunately, I do not have the text of the ECHR in front of me—however, it is arriving quickly from left field. Article 5(5) very clearly says:

“Everyone who has been the victim of arrest or detention in contravention of the provisions of this article shall have an enforceable right to compensation.”

Article 5 is the right to liberty and security. There are ECHR barriers that prevent me, sympathetic as I am, from accepting the hon. Gentleman’s amendment.
