Is it correct that, if the provision were passed, and if I came before a magistrate as a joy rider charged and convicted of aggravated vehicle taking in a case in which the damage caused was £4,999, such that the offence was summary only, the magistrate would not have power to suspend the sentence, but that if the damages were £5,000.01, the offence would be an either-way offence and the power would exist? How would your members react to the lack of discretion concerning criminal damage worth less than £5,000?
