On the unfairness test, does the Minister accept the point made by John Battle, that many individuals involved in such cases do not want to get anywhere near court? If so, what does he have to say to him? It is one thing to say that an alternative dispute resolution is available, but people—in particular those at the lower end—do not need a neutral arbiter, but need someone to stand up for them against these wicked people?
