The hon. Gentleman is trying to create the illusion that there will be no constraints on the shift in power from member states to the Community. He has not mentioned article 3b and the way in which powers will be constrained. I refer him to the words: The Community shall act within the limits of the powers conferred". The text also makes it clear that the onus of proof that powers should be removed from member states is on those who would remove them—not the other way around. That represents an important restriction on the ability to shift powers, and the hon. Gentleman has not referred to it at all.
