The right hon. Member said earlier that the Secretary of State should use his discretion. My understanding of the Act is that the Secretary of State does not have discretion and that he shall not approve such a merger without referring it to the commission. Is that what the right hon. Gentleman is saying, or is he saying that there is a discretion?
