The defendant has an equal right to make a similar application. He can go before the Court of Justice and ask to have the case tried by a jury, or say he does not want it tried before a jury, but is quite satisfied to submit himself to a Judge. There is a second reason. Trial by jury is an expensive item. One of the parties has to pay for it.
