To ask the Secretary of State for Culture, Olympics, Media and Sport what guidance her Department offers to people receiving marketing telephone calls despite being (a) ex-directory and (b) registered with the Telephone Preference Service.
The Department for Culture, Media and Sport provides guidance stating that complaints of this nature should be reported to the Information Commissioner's Office (ICO). This is because under the Privacy and Electronic Communications Regulations (PECR) 2003 the ICO has responsibility for considering complaints relating to the Telephone Preference Service (TPS). The ICO can take formal action against those in breach of the regulations, and can issue a fine of up to £500,000. Complaints can be registered with the ICO at:
