To ask the Minister of State, Department for Transport if he will bring forward proposals to amend the Employments Rights Act 1996 to extend the definition of Working Time Regulations to include the Road Transport (Working Time) Regulations.

The Department for Transport is aware of the issue regarding a possible lack of provision in the Road Transport (Working Time) Regulations 2005 for mobile workers to seek redress via employment tribunals.

Departmental officials are exploring the implications of a change to the Employment Rights Act 1996, via an amendment to the Road Transport (Working Time) Regulations 2005, with the Department for Business, Innovation and Skills and the Tribunals Service.

When all the facts are known, a formal decision will be made on whether changes are needed. Any proposals for change will need to be the subject of a consultation process.
