To ask the Secretary of State for the Home Department whether family applications to be re-united with those given leave to remain are required to meet the test that they will (a) not be dependent on public funds and (b) have adequate accommodation.

Family applications to be re-united with those given indefinite leave to remain are normally expected to meet the maintenance and accommodation requirements of the Immigration Rules. However, applications made to join either recognised refugees and those granted humanitarian protection on or after 30 August 2005, or relatives of EEA nationals, are not expected to satisfy the maintenance and accommodation requirements.
