I think that I followed the hon. Gentleman’s argument, and I suggest that it is an either/or situation. The seller is required to provide either a sustainability certificate or a written statement to that effect. Subsection (8) deals with non-compliance conditions, and it is either the sustainability certificate or the written statement that need not be supplied. However, I understand the logic of the hon. Gentleman’s argument about why a seller would not provide a written statement, which returns to the point about “reasonable excuse” that he made earlier.
