I am sympathetic to not giving up people’s right to resist other people entering their property to enforce civil debts and so on, but I have also believed for a long time that we ought to codify our law so that people can find it all in one place. Is not the weakness of the argument for keeping the common law as it is the old problem that people will not know what the law is as clearly as if it were all written down in one place? I do not dissent from the objective, but I am concerned about the means.
