As long as the court deems it appropriate. The right hon. and learned Gentleman referred continually to the McCann case, in which it was found that ASBOs were a civil measure. He drew attention to article 6.2 of the European convention on human rights, which does not apply because we are talking about a civil measure; however, article 6.1, on the right to a fair trial, will apply.
