My hon. Friend has once again put her finger on it. Little is known about what impaired decision making or judgment would mean. We have the Mental Capacity Act, and I suggest that the clause would confuse impaired judgment and lack of capacity. We would be venturing down a track about which we know little and imposing confusion on the existing conditions.
