As we begin to tease out this issue—subsection (1) makes it clear that it is about the agency—I have it in mind that the agency may nevertheless be required to pick up on private arrangements in which maintenance is not being paid. The question is whether it can charge fees retrospectively, as if were, on that portion of unpaid maintenance that was missed before it became directly involved?
