The hon. Gentleman is right; that is a well established legal route established in much legislation. I simply point out the possibility of problems or challenges to the clause in court. We need to give the police as much flexibility as possible. Clause 5 is one of the Government's flagship clauses, and to make it work properly we need to support the amendment.
