The amendment requires the Secretary of State to consult the NDA before entering into agreements for the purposes of accepting or imposing contractual obligations. I am sure that the Minister will say that it is not necessary, but a requirement to consult the NDA before entering into those agreements seems slightly lacking from subsection (1).
