Given that we are being so careful with language, will the hon. Gentleman be careful about what he says? He has suggested that there is inconsistency, but I have made it clear that it is the application of the same principles that leads to the conclusion that it would be inappropriate to allow the registrar and the tribunal to consider the options that he has mentioned. The application of the principles is exactly the same; it is the consideration of the evidence that is different.
