That is exactly my understanding of the difference between us. If the difference is not measurable, one is at the level of comparability where there is an insignificant difference, and that means that it would be possible to have all sorts of spurious and trivial arguments—I shall not try to invent another new word for the English language. The issue is worth teasing out. There is always a danger that we use
terminology in an everyday way that is different from the way in which has been tried and tested from a legal point of view.
