I can be brief. In subsection (2) Ofcom is required, in accordance with paragraph 13(1) of the access directive, to take account of the extent of investment, but the directive goes on to say that what should be taken into account is not simply the investment made by the operator but to

£''allow him a reasonable rate of return on adequate capital employed, taking into account the risks involved.''

£Can we be assured that that is intended to be what clause 84(2) actually delivers?
