Clause 4 - Advertising: exclusions
Tobacco Advertising and Promotion Bill [Lords]
2:45 pm

Ms Yvette Cooper (Parliamentary Secretary (Public Health), Department of Health; Pontefract and Castleford, Labour)
Even after listening to the hon. Gentleman's argument, I still cannot see why his amendment is necessary. To be honest, I do not see how it would change the Bill in any way. He seemed to be saying that advertisements in wholesalers are not communications, but they are. They would be permitted as exclusions in the Bill subject to the conditions in clause 4 (2) only if they were directed solely at people engaged in the trade with particular ''responsibility for making decisions''. Otherwise, communications would also include such advertisements. It is not clear how removing ''communication'' would add to the Bill. It is hard to see how one could advertise without communicating. How could one have a tobacco advertisement that was not a communication of some sort? The amendment does not add to or detract from the Bill, so it is unnecessary.
