Let me be clear. The Minister is saying that that is a matter for the employer's judgment, but that puts the employer in an invidious position. The Minister apparently envisages that if the employer calls that judgment wrongly, the tribunal could draw a negative inference in a hearing. That places on the employer a heavy burden that he should not have to face when juggling statutory obligations and a duty of confidentiality to employees.
