Is the Minister saying that where an employer is asked questions about an individual employee, thus being invited to breach his duty of confidentiality to that employee, his failure to respond could not give rise to a negative inference by the tribunal, as the Bill suggests would happen when an employer fails properly to reply to a questionnaire?
